    How to apply for Work Permit:<\/strong><\/p>\n\n\n\n

      \n
    1. A foreigner who wishes to apply for a work permit must receive a Non-Immigrant (B) visa to live in the Kingdom of Thailand. A foreigner should have employer\u2019s documents plus employment contract in order to submit a Non-Immigrant (B) visa at a Royal Thai Embassy. And then a foreigner enters to Thailand have to apply for Work Permit by means of applying \u201cWP.25\u201d.<\/li>\n\n\n\n
    2. In case when a Royal Thai Embassy considers that employer\u2019s documents is not enough, an approval letter from Ministry Of Labour will be required. So the employer applies for a work permit for prospective foreigner employees by means of applying \u201cWP.32\u201d. In case the employer receives an approval letter of Work Permit, employer sends the letter to foreigner in order to apply for a Non-Immigrant (B) visa at the Royal Thai Embassy. Then the foreigner has to enter to the Kingdom in order to apply for a Work Permit with documents which specified in the letter within 30 days from the day of picking up the approval letter.<\/li>\n<\/ol>\n\n\n\n

      However, a foreigner who has a Certificate of Permanent Residence and Certificate of Alien apply for Work Permit by means of applying \u201cWP.25\u201d. A Non-Immigrant (B) visa is not required.<\/p>\n\n\n\n

      <\/p>\n\n\n\n

      Qualifications of foreigner for Work Permit application:<\/strong><\/p>\n\n\n\n

        \n
      1. Possess knowledge and skills for the job applied for.<\/li>\n\n\n\n
      2. Not being insane or mentally sick, suffering from Leprosy, Tuberculosis, Drug Addiction, Alcoholism, Elephantiasis and third stage of Syphilis.<\/li>\n\n\n\n
      3. Not being insane or mentally sick, suffering from Leprosy, Tuberculosis, Drug Addiction, Alcoholism, Elephantiasis and third stage of Syphilis.<\/li>\n\n\n\n
      4. Never having been imprisoned for violation of the Immigration Law or the Working of Foreign Act at least one year prior to the date of application.<\/li>\n<\/ol>\n\n\n\n

        <\/p>\n\n\n\n

        Criteria for consideration for Work Permission:<\/strong><\/p>\n\n\n\n

          \n
        1. Political, religious, economic, and social stability within the Kingdom.<\/li>\n\n\n\n
        2. The occupational opportunity of Thais and the demand of foreign workers as necessary for the country development. (For example, 1 Foreigner must employ 4 Thai employees)<\/em><\/li>\n\n\n\n
        3. The benefits from allowing foreigners to work in that position, such as bringing a large amount of foreign currency into the country for investment or spending, employing a large number of Thais, or developing Thai skills that are transferred from permitted foreign workers.<\/li>\n<\/ol>\n\n\n\n

          <\/p>\n\n\n\n

          Criteria prescribing number of Work Permit issuance:<\/strong><\/p>\n\n\n\n

            \n
          1. The employers whose business<\/strong>has a registered paid-up capital of not less than 2 million baht. Work Permit shall be issued to an alien worker for every 2 million baht investment or the overseas registered employers who perform business in Thailand with an investment of capital from overseas of not less than 3 million baht; Work Permit shall be issued to an alien worker for every 3 million baht investment. For the aliens who are married to Thai nationals and have a marriage certificate and cohabit as husband or wife, the amount of investment capital required in order to receive a Work Permit shall be reduced to half of the amount prescribed above. The number of alien workers to be granted Work Permit shall not be more than ten people.<\/li>\n\n\n\n
          2. Issuing work permits for foreigners<\/strong>to employers\/establishments as follows: The number of work permits issued is as necessary and appropriate.<\/li>\n<\/ol>\n\n\n\n

            2.1 Performing export business and bringing foreign currencies into Thailand at least 30 million baht in previous year.\u0e2a\u0e32\u0e21\u0e2a\u0e34\u0e1a<\/em>\u0e25\u0e49\u0e32\u0e19\u0e1a\u0e32\u0e17\u0e02\u0e36\u0e49\u0e19\u0e44\u0e1b\u0e43\u0e19\u0e1b\u0e35\u0e17\u0e35\u0e48\u0e1c\u0e48\u0e32\u0e19\u0e21\u0e32<\/p>\n\n\n\n

            2.2 Performing tourism business which broughtat least 5,000 foreign tourists<\/em>into Thailand in previous year.<\/p>\n\n\n\n

            2.3 The establishment employs not less than one hundred Thai people.<\/p>\n\n\n\n

            2.4 Job that uses technology that Thai people can\u2019t do or uses specialized knowledge to accomplish the job under a project that has a definite period of time.<\/p>\n\n\n\n

            2.5 Enterprises pay income tax to the government in the past year not less than 3 million baht.<\/p>\n\n\n\n

            2.6 For the aliens who work with and have certified letters from central or regional or local government offices, state enterprises and public organizations under Public Organization Act which identifies name, position and duration of work, or<\/p>\n\n\n\n

            2.7 A private educational institution which has a letter appointing a teacher\/teacher\/educational personnel according to the law governing private schools. Law on Private Higher Education Institutions<\/p>\n\n\n\n

            2.8 The alien work for a foundation, association or other nonprofit organizations, which create benefits to society as a whole, or<\/p>\n\n\n\n

            2.9 Entertainment business, entertainment, music, which has an occasional nature of employment for a fixed period of time.<\/p>\n\n\n\n

            2.10 Others which is defined in the Criteria for the Consideration for Work Permit Issuance B.E.2552<\/p>\n\n\n\n
