What is a Work Permit?

A Work Permit is a license for foreigners to work. It is an essential document for foreigners when they have to travel to work in other countries for business, operations, or employment for a specified period. The employer in each country will proceed with the application, which must be approved by the Labor Ministry of that country to employ foreigners. When it expires, it must be renewed immediately. If the employee changes workplaces or employers, they must reapply. Foreigners who need to work in Thailand for business, operations, or any profession must apply for a Non-Immigrant B visa or business visa, and they must apply for a work permit, otherwise, they will not be able to work in the Kingdom of Thailand.

  1. A foreigner who wishes to apply for a work permit must receive a Non-Immigrant (B) visa to live in the Kingdom of Thailand. A foreigner should have employer’s documents plus employment contract in order to submit a Non-Immigrant (B) visa at a Royal Thai Embassy. And then a foreigner enters to Thailand have to apply for Work Permit by means of applying “WP.25”.
  2. In case when a Royal Thai Embassy considers that employer’s documents is not enough, an approval letter from Ministry Of Labour will be required. So the employer applies for a work permit for prospective foreigner employees by means of applying “WP.32”. In case the employer receives an approval letter of Work Permit, employer sends the letter to foreigner in order to apply for a Non-Immigrant (B) visa at the Royal Thai Embassy. Then the foreigner has to enter to the Kingdom in order to apply for a Work Permit with documents which specified in the letter within 30 days from the day of picking up the approval letter.

However, a foreigner who has a Certificate of Permanent Residence and Certificate of Alien apply for Work Permit by means of applying “WP.25”. A Non-Immigrant (B) visa is not required.

  • Possess knowledge and skills for the job applied for.
  • Not being insane or mentally sick, suffering from Leprosy, Tuberculosis, Drug Addiction, Alcoholism, Elephantiasis and third stage of Syphilis.

*N.B. As per the Cabinet’s Resolutions, foreign workers from (Myanmar, Laos and Cambodia) have been given an indulgence to work in the Kingdom in 2 occupations, which are 1) Labour work and 2) Domestic work.

  1. Political, religious, economic, and social stability within the Kingdom.
  2. The occupational opportunity of Thais and the demand of foreign workers as necessary for the country development. (For example, 1 Foreigner must employ 4 Thai employees)
  3. The benefits from allowing foreigners to work in that position, such as bringing a large amount of foreign currency into the country for investment or spending, employing a large number of Thais, or developing Thai skills that are transferred from permitted foreign workers.
  1. The employers whose businesshas a registered paid-up capital of not less than 2 million baht. Work Permit shall be issued to an alien worker for every 2 million baht investment or the overseas registered employers who perform business in Thailand with an investment of capital from overseas of not less than 3 million baht; Work Permit shall be issued to an alien worker for every 3 million baht investment. For the aliens who are married to Thai nationals and have a marriage certificate and cohabit as husband or wife, the amount of investment capital required in order to receive a Work Permit shall be reduced to half of the amount prescribed above. The number of alien workers to be granted Work Permit shall not be more than ten people.
  2. Issuing work permits for foreignersto employers/establishments as follows: The number of work permits issued is as necessary and appropriate.

2.1 Performing export business and bringing foreign currencies into Thailand at least 30 million baht in previous year.สามสิบล้านบาทขึ้นไปในปีที่ผ่านมา

2.2 Performing tourism business which broughtat least 5,000 foreign touristsinto Thailand in previous year.

2.3 The establishment employs not less than one hundred Thai people.

2.4 Job that uses technology that Thai people can’t do or uses specialized knowledge to accomplish the job under a project that has a definite period of time.

2.5 Enterprises pay income tax to the government in the past year not less than 3 million baht.

2.6 For the aliens who work with and have certified letters from central or regional or local government offices, state enterprises and public organizations under Public Organization Act which identifies name, position and duration of work, or

2.7 A private educational institution which has a letter appointing a teacher/teacher/educational personnel according to the law governing private schools. Law on Private Higher Education Institutions

2.8 The alien work for a foundation, association or other nonprofit organizations, which create benefits to society as a whole, or

2.9 Entertainment business, entertainment, music, which has an occasional nature of employment for a fixed period of time.

2.10 Others which is defined in the Criteria for the Consideration for Work Permit Issuance B.E.2552

A Work Permit is issued for 2 year period and may be renewed every two year thereafter

An authorized official may grant a work period according to the necessity of work, but for not later than 2 yearไม่เกิน 2 ปี

The Work Permit holder whose Work Permit is going to expire but wish to continue work as stated in the Work Permit. The renewal application should be submitted before the expiry date of Work Permit by means of “WP.25”. “The expired Work Permit is unable to renew”

Foreigners who have received a work permit

1. Changing the location of the head office or branch in the former establishment which in addition to the original permission

The Work Permit holder has to notify the Immigration Bureau of such change and request to continue for staying in Thailand or the foreign worker has to travel out of the Kingdom of Thailand in order to apply for a new non-immigrant visa from Royal Thai Embassy abroad. After entering to the Kingdom, then apply for a new Work Permit “WP.25” before the expiry date of visa.

The Work Permit holder require for changing

  • name – surname, nationality,
  • signature,
  • address /or company/enterprise,
  • change any information according to the government declaration,
  • addition of type of business.

Should submit “Application for Changing Items in Work Permit”.

Work Permit is materially damaged or lost. The Work Permit holders must apply for a substitute Permit within 15 days from the day of the knowledge of such damage or lost by means of “WP.4”.

Request to cancel work permit In the event that an alien who holds a work permit resigns from his or her job or the employer gives The foreigner quit his job and if they wish to inform the registrar Submit a notification in the form “Notice of cancellation of work permit” after the foreigner has retired from work without penalties or deadlines for notification.

Foreigner workers who enter the kingdom of Thailand to engage in the work, which is of necessity or urgency for the period not longer than 15 days, should notify “WP.35+ WP.37”.

However, that work must exceedingly necessary and urgent as if there will be the serious problem, if it could not to be done immediately. And that work could be finished within a period of 15 days.

Remark: it can not to be no more renewal.

The place for submitting applications for processing shall be at the workplace of the applicant, as follows:

  • • An enterprise located in Bangkok, contact the Office of Foreign Workers Administration 2nd Floor, Department of Employment, Ministry of Labour, Mitr-maitri Road, Din Daeng, Bangkok.
  • An enterprise located in other province, contact the Provincial Employment Office in the province that the enterprise located.

(6) Permission to change or add employer 3,000 Baht

(7) Permission to change or add the locality or workplace 1,000 Baht

(8) Permission to change or add conditions 150 Baht

  1. Alien must keep the Work Permit on himself or at the place of work during working hours.
  2. In case the foreign worker change the employer, he/she has to notify the Immigration Bureau of such change and request to continue for staying in Thailand with the new employer or the foreign worker has to travel out of the Kingdom of Thailand in order to apply for a new non-immigrant visa from Royal Thai Embassy abroad. After entering to the Kingdom, then apply for a new Work Permit (Form WP.25) before the expiry date of visa.
  3. Alien must perform to work in a job which is permitted in the Work Permit. If a holder needs to work for the other job or location or work place, a holder must be permitted by the Registrar before working. Whoever abuses the Law will be imprisoned not exceeding five years or fined or both.
  4. Work Permit must be extended before expiry. The expired permits cannot be extended.
  5. Changing name, surname, nationality and address of applicant or name of company/enterprise must notify to the registrar immediately.
  6. The employer is not allowed to employ the foreigner worker who does not have the Work Permit or employ them to engage in the work that its job description or condition is different from the job description or condition specified in the Work Permit. The violator shall be liable to be fine not exceeding 100,000 Baht.

The minimum salary rates by nationality are as follows:

  1. 1. Europe and Australia Japanese, American and Canadian nationality, minimum salary 50,000 baht / month
  2. Nationality: Korean, Taiwan, Hong Kong, Singapore, Malaysia, minimum salary 45,000 baht / month
  3. Indian nationality, Middle East group, China, Indonesia, Philippines, minimum salary 35,000 baht / month.
  4. Nationality of Burma, Laos, Vietnam, Cambodia and Africa Minimum salary 25,000 baht / month
  5. Newspaper business Minimum salary 20,000 baht / month

Criteria for Considering Work Permit Application

Qualifications of foreigners applying for a work permit

  1. Foreigners who are domiciled in the Kingdom or have been allowed to enter the Kingdom temporarily under the law concerning immigration (Non-Immigrant), but not as tourists or transit passengers, must apply for a new permit either when they are first allowed to work or when their previous permit expires.
  2. Possess knowledge and skills for the job applied for.
  3. Not a person of unsound mind or suffering from any of the following diseases: leprosy, tuberculosis in dangerous stages, elephantiasis in symptomatic stages, drug addiction, or chronic alcoholism.
  4. They must not have been imprisoned for a violation of the immigration law or the law on the employment of foreigners within 1 year before the date of the application.

  • Does the business generate income for the country, such as an export business or tourism?
  • Is modern technology being employed and transferred to Thai people?

What is a Non-B (Non-Immigrant Visa B)

Non – Immigrant Visa “B” or Non-B visa is a type B temporary stay visa issued to those who wish to travel to Thailand for work, business contact, attending meetings in Thailand. There are both single-entry Non-B visas with a validity of 3 months from the date of visa application and can stay in Thailand for no more than 90 days, and multiple-entry Non-B visas with a validity of 1 year from the date of visa application and can stay in Thailand for no more than 90 days per time, which will be issued only for business contact cases.

What is a Non-ED (Non-Immigrant Visa ED)?

Non-Immigrant “ED” or Non-ED visa is an ED type temporary stay visa issued to those who wish to travel to Thailand for full-time study in state and private educational institutions, internships in government agencies, state enterprises, and international organizations, internships as part of an educational curriculum, and study in other educational curriculums. This Non-ED visa is a single-entry visa with a validity of 3 months from the date of visa application and can stay in Thailand for no more than 90 days.

What is a Non-O (Non-Immigrant Visa O)?

Non-Immigrant “O” or Non-O visa is an O type temporary stay visa issued to those who wish to travel to Thailand for various purposes, such as family members of Thai nationals, dependents of foreigners working or studying in Thailand, volunteers for foundations or charitable organizations, end-of-life (retirement). This Non-O visa is a single-entry visa with a validity of 3 months from the date of visa application and can stay in Thailand for no more than 90 days.

Notification of Stay in the Kingdom of Thailand for Foreigners Staying Over 90 Days

Foreign nationals who are granted temporary permission to stay in the Kingdom of Thailand or who hold a temporary (Non-Immigrant) visa include those with:

  • Business Visa (Non-B)
  • Work Visa (Non-B)
  • Retirement Visa (Non-O)
  • Marriage Visa (Non-O)
  • Dependent Visa (Non-O)
  • Volunteer Visa (Non-O)

If they stay in the Kingdom for more than 90 days, they are required to report their residence to the immigration office every 90 days. If the location has an immigration office, they can report to the officials there. Foreigners who fail to report their stay or report late and have stayed over 90 days are required to report in person and pay a fine of 2,000 Baht.

If they are apprehended for any reason and have not reported, they are subject to a fine of 5,000 Baht as per Section 37(5) of the Immigration Act B.E. 2522 (1979).
